Terms of Service

By registering for or using Foxlab CRM ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("the User") and Foxlab, the operator of foxlabcrm.com.

Foxlab CRM is a cloud-based customer relationship management platform designed for small and medium-sized businesses in Romania. The Service helps businesses manage contacts, companies, deals, sales pipelines, tasks, email campaigns, invoices, and related business processes. The Service is provided as-is and may be updated from time to time. Foxlab CRM is accessible at foxlabcrm.com and is operated from Romania.

To use Foxlab CRM, you must:

• Provide accurate and complete registration information
• Be at least 16 years of age
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. Each account is associated with a single organization. You may not share accounts between individuals. The organization administrator is responsible for managing team members and their access levels.

You retain full ownership of all data you enter into Foxlab CRM. In accordance with the EU General Data Protection Regulation (GDPR) and Romanian Law 190/2018, we act as a data processor on your behalf for the business data you manage through the platform. You remain the data controller for the personal data of your contacts.

• You can export your data at any time using the built-in export features (CSV format)
• We will not access your data except to provide the Service, for support when requested, or as required by Romanian or EU law
• We do not sell, rent, or share your data with third parties for their marketing purposes

You agree not to use Foxlab CRM to:

• Send unsolicited commercial communications (spam)
• Upload or use purchased, rented, or scraped contact lists
• Violate any applicable Romanian, EU, or international laws or regulations
• Infringe on the intellectual property rights of others
• Distribute malware or engage in any activity that compromises the security of the Service
• Attempt to gain unauthorized access to accounts, systems, or data
• Use the Service for any activity that is fraudulent, deceptive, or harmful

We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable.

When using Foxlab CRM to send email campaigns, you must:

• Only send emails to recipients who have given their explicit consent (opt-in) to receive communications from you, in compliance with GDPR
• Comply with all applicable anti-spam laws, including the EU ePrivacy Directive, GDPR, and Romanian Law 365/2002 on electronic commerce
• Include a valid unsubscribe mechanism in every campaign email
• Honor unsubscribe requests promptly — Foxlab CRM processes unsubscribes automatically
• Include your business identity and contact information in campaign emails

Violation of email sending policies may result in immediate suspension of campaign sending privileges.

We strive to maintain high availability of Foxlab CRM but do not guarantee uninterrupted or error-free service. The Service is provided on a best-effort basis. We may perform scheduled maintenance with advance notice when possible.

We are not liable for any downtime, data loss, or damages resulting from service interruptions, whether planned or unplanned.

To the maximum extent permitted by Romanian and EU law, Foxlab CRM and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total aggregate liability for any claims arising from or related to your use of the Service shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

Either party may terminate this agreement at any time. You may terminate by cancelling your subscription and deleting your account from the Settings page. We may terminate or suspend your access if you violate these Terms, with notice where practicable.

Upon termination, your data will be retained for 30 days to allow retrieval, after which it will be permanently deleted. You may request an export of your data before account deletion.

We may update these Terms from time to time. We will notify registered users by email of material changes at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

The "Last updated" date at the top of this page reflects the most recent revision.

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising from or relating to these Terms or your use of Foxlab CRM shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania. The provisions of EU Regulation 524/2013 regarding online dispute resolution for consumer disputes apply.
